25 May 2018 marks the effective date of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. Pursuant to Articles 13 and 14 of the Regulation, we would like to provide you with the required information, which includes information about your rights related to processing of your personal data by IPD Consulting Sp. z o.o.
1. IPD Consulting Spółka z ograniczoną odpowiedzialnością, a limited liability company having its registered office in Chrzanow, 32-500 Kolonia Stella 43, holder of tax ID number (NIP): 625-20-25-675, Statistical No (REGON): 273760015, e-mail: inf@ipd.com.pl., is the Controller of your personal data. Ms Kamila Kamińska acts as the Data Protection Officer.
2. Your personal data will be processed for the following purposes:
a. for the performance of a contract to which the data subject or a company which the data subject represents is party or in order to take steps at the request of the data subject prior to entering into a contract, pursuant to Article 6(1)(b)
b. for the purposes of legitimate interest of the Controller or a third party, consisting of establishing contacts with potential new customers in order to offer the Controller’s products or services, for marketing and advertising activity, for the establishment, exercise or defence of legal claims, if any, etc.
c. for compliance with legal obligations to which the Controller is subject under generally applicable laws, including the accounting law, tax regulations and other legislation, pursuant to Article 6(1)(c).
d. for sales and marketing purposes pursued by the Controller based on your consent to process your personal data, pursuant to Article 6(1)(a).
3. Your personal data has been obtained in one of the following ways:
a. by direct disclosure of your personal in your business card, traditional correspondence or email
b. from sources and registers available to the general public, such as: the Central Registration and Information on Economic Activity (CEIDG), the National Court Register (KRS), the Statistical Records (REGON), records of the tax identification numbers (NIP), Polish classification of business activity (PKD), company websites, or at the phone numbers available online;
c. disclosure, by any means, of the data required to prepare and perform a contract.
4. Given the specific nature of our business activity, the following categories of data will be processed: personal data used in business, i.e. first name, surname, phone number and email address. The data will be combined with data which does not constitute personal data and does not permit to identify a natural person, such as: business name, tax identification number (NIP), national court register number for companies (KRS), statistical identification number (REGON), company websites, bank account numbers, names of organisational units in companies, position in a company, company’s area of business, etc.
5. Your personal data will be disclosed to entities which provide services to the Controller to the extent necessary to perform a contract concluded or planned to be concluded with you, such as: bookkeeping services, courier services, postal services, telecommunication services, legal services, analytical and marketing services, debt recovery, settlement of contracts, banking services for the purpose of making payments. Your data will also be disclosed to authorities competent to receive your data under mandatory legal regulations.
6. The Data Controller does not intend to transfer your personal data to any third country or international organisation.
7. Your personal data will be processed for the longest of the following periods only:
a. the time required by law, which includes the accounting and tax regulations,
b. a period not exceeding 3 years from the last contact,
c. a period of use of a solution subject to guarantees and similar services,
d. duration of a contract concluded by the parties,
e. a period required to exercise or defend claims, if any, by the Controller.
The period of data storage may each time be extended until the end of the claim limitation period.
8. You have a right to request access to your personal data, rectify the data, erase it, limit its processing, object against processing, as well as the right to transmit your data.
9. You have a right to lodge a complaint with the supervisory authority for personal data protection if you consider that the processing of your personal data infringes the provisions of the Regulation 2016/679.
10. The Controller requires disclosure of personal data for the purpose of making a response, providing information or preparing, concluding and performing a contract. If personal data is not disclosed, the Controller will not able to make a response, provide information or prepare, conclude and perform a contract.
11. The obligation to inform about the personal data shall be fulfilled by the Controller after the data has been obtained within maximum one month or upon the first communication to the data subject.
12. The obligation to inform will be fulfilled depending on the source of the data and the available communication medium:
a. for data received in the form of a business card: by sending an email message containing a link to this information
a. for data received in traditional correspondence: by responding in a traditional manner or with an email message containing a link to this information
a. for data received in an email exchange: by responding with an email message containing a link to this information
13. If it is necessary to erase your data, all your personal will be erased from the data carriers and registers/records.
